1. Introduction
Welcome to TCN Networks. By using our services, you agree to abide by the following Terms of Service (TOS). These terms apply to all services provided by TCN Networks, including Virtual Private Servers (VPS) and Dedicated Servers. If you do not agree to these terms, please do not use our services.
2. Services Provided
TCN Networks provides hosting solutions, including but not limited to VPS and dedicated servers. These services are subject to the terms outlined herein and are offered to customers worldwide, subject to applicable laws and regulations.
3. Account Eligibility
You must be at least 18 years of age to register for our services. By signing up, you warrant that the information provided is accurate, complete, and up-to-date.
4. Prohibited Uses
- No illegal activities, including but not limited to hosting copyrighted materials without proper authorization, phishing, fraud, or distributing malware.
- No resource abuse, including excessive CPU, bandwidth, or disk usage that impacts other users.
- No spamming, including unsolicited emails, mass messaging, or related activities.
5. Payment and Billing
- All invoices must be paid by their due date. Services may be suspended for overdue payments.
- Recurring services will be automatically renewed unless canceled in advance.
- Refunds are provided at TCN Networks' sole discretion and only in accordance with our refund policy.
6. Uptime Guarantee
TCN Networks guarantees a 99.9% uptime for all services. Scheduled maintenance or events outside of our control (e.g., natural disasters, DDoS attacks) are excluded from this guarantee.
7. Data Backup and Responsibility
Customers are responsible for maintaining their own backups. While we may offer backup services, we cannot guarantee the integrity of your data.
8. Termination of Services
- We reserve the right to suspend or terminate services for violations of this TOS or for failure to make payments.
- Customers may terminate services by providing notice via their client area.
9. Liability and Indemnification
TCN Networks is not liable for any damages, direct or indirect, resulting from the use or inability to use our services. Customers agree to indemnify and hold harmless TCN Networks from any claims arising out of their use of our services.
10. Amendments
TCN Networks reserves the right to amend these terms at any time. Changes will be communicated via email or through our website. Continued use of services after amendments constitutes acceptance of the new terms.
11. Governing Law
This agreement is governed by the laws of the State of Nevada, without regard to its conflict of laws principles. Any disputes must be resolved in a court of competent jurisdiction within Nevada.
